At Community Association Law Group, we think of ourselves as part of the management team for our community association clients. Because community associations are not just groups of homeowners, but nonprofit corporations with significant assets, our contribution focuses on helping boards and managers recognize the association’s legal obligations, identify the sources and limits of its authority, and understand and navigate the procedures required by its governing documents.

Dispute Resolution & Litigation

The best litigators are not the ones that litigate every case they come across – they’re the ones who understand when and when not to litigate to obtain the best outcome for the client. Our litigation background gives us a unique perspective because in addition to applying what we know about how the courts operate, how judges apply community association law, and how juries perceive our communities, we also understand the realities of litigation and the impact it can have on the community, including the directors, owners, and managers.

Maintenance & Repair

Identification of maintenance and repair responsibilities for common elements, limited common elements and units, including specific components such as doors, windows, roofs, fences, sidewalks & street trees; capital improvement projects or major remediation and loan projects such as siding or roof replacement

Vendor Contracts & Disputes

Negotiation and review of AIA contracts, review and drafting of vendor contracts, breach and termination analysis, dispute resolution, lien analysis, litigation

Federal Law & Regulation Compliance

FHA/HUD compliance or project approval; reasonable accommodation requests; service and emotional support animals; HUD complaints; discrimination complaints; federal regulations regarding flags, satellite dishes, and Housing for Older Persons (HOPA)

Owner Compliance & Enforcement

Procedures for notice and opportunity to be heard; hearings board procedures; enforcement policies; fine schedules, warning letters, notices of violation, negotiation, mediation, dispute resolution and litigation. Our firm does not typically collect assessments from community association members, but does handle complex developer collections or collections associated with enforcement issues. We do have contacts for collections attorneys who we can recommend and procedures for sharing files for such matters.
